TERMS & CONDITIONS
Offer and acceptance
editeur contracts on the following terms. By accepting our Quotation/Invoice, is deemed that you have read and accepted these terms and conditions. It is the customer’s responsibility to proof read the order confirmation upon receipt and immediately notify editeur of any discrepancies. Orders are accepted, manufactured and invoiced in accordance with the quantities, specification, price, and payment terms as contained in our Quotation.
Finishes and samples
Fabric, leather, and material samples shown and given to the customer serve as a guide and may vary from the actual finish received, as each batch differs. editeur will not accept any claim for these variations between samples and the final product.
Payment
Unless otherwise confirmed in writing by editeur 50% deposit is due to process an order and commence production. The subsequent final payment is due prior to delivery.
Payment by EFT will not incur any merchant fee charges. Payment by credit card for any order exceeding $25,000.00 may incur a 2% merchant fee.
Cancellations
Orders where a deposit has been paid to commence production cannot be cancelled, nor can orders in the process of manufacture be altered without written consent from editeur. Products are made to order as per specification requested by the customer.
Delivery
Unless otherwise confirmed in writing all deliveries including specific delivery instructions, unpacking, and installation services are chargeable at an additional cost.
Delivery and installation are offered during normal working hours, Monday to Friday, AM or PM delivery slots. Alteration or cancellation of delivery and installation arrangements less than 72 hours in advance may incur a charge.
It is the customers responsibility to check dimensions of goods in relation to property access, lifts, stairwells and final location. Delivery occurs once editeur's delivery docket has been signed or have been delivered to your nominated point of delivery, at which stage goods are at the customers risk and editeur is not liable for any loss or deterioration.
Scheduled dispatch and delivery
editeur will provide the client with an approximate lead time for the arrival of their goods and update any major changes, as provided to them by the Supplier. The client should then be prepared for delivery within that time frame. Upon notice of arrival, the balance of Invoice will be payable ahead of the scheduled delivery/collection date. If the delivery dates are varied by the customer, editeur reserves the right to issue the invoice for payment in accordance with the original agreed dates and payment terms. Completed goods ready for delivery may be stored for a period of up to 2 weeks without charge, subject to availability. After which storage charges will apply at commercial rates per cubic meter, payable prior to release of goods and Insurance will be at the client’s expense and responsibility.
Ownership of goods and insurance
The title of the merchandise will not pass on to the customer until editeur has received payment in full for all goods and charges. At such time Insurance will be at the expense and responsibility of the client unless 3 weeks storage has been approved.
Damage or faulty workmanship
The customer will be responsible for immediate examination of the goods upon delivery, and shall give notice to editeur by phone or email detailing any shortages, damage or other errors in delivery within 24 hours. A formal claim with images must be received within 3 working days otherwise editeur will not accept the claim. (This is deemed an appropriate amount of time to inspect the goods). If the customer fails to give such notice within three (3) business days from the time the goods were delivered, the goods shall be deemed to have been accepted in good order by the customer. editeur then reserves the right to repair or replace, damaged or faulty made-to-order products.
Returns
Return of goods will only be accepted, subject to the following conditions;
Damage or faulty workmanship, order discrepancies at the fault of the manufacturer or editeur, and at the discretion of Management under extenuating circumstances.
Goods must be returned in their original packing and in the same order and condition as at the date of original delivery. Goods will be subject to inspection prior to acceptance of returned goods.
Manufacturers’ products are constantly changing, evolving, and improving. The right to change or discontinue at any time without prior notice remains the right of the manufacturer.
Advice
editeur supplies product recommendations, information and advice based on suppliers’ product disclosure.
Any advice or recommendations supplied by editeur are provided in good faith without liability or responsibility on the part of editeur.
Warranty
Unless otherwise advised warranty is 2 years from date of invoice. Vintage pieces are bought ‘as is’ and bear no warranty. Please refer to the manufacturer’s warranty on individual items, in accordance with the date of purchase and editeur issued Invoice. editeur 's liability for defective goods and loss caused by defective goods is at our discretion, limited to either repair, replace or refund of the purchase price of the product only. The warranty only applies within the Commonwealth of Australia and to, in the case of new goods, the original customer to whom the goods were first sold and excludes second hand and used goods. All conditions and warranties implied by law are expressly excluded to the extent that they are lawfully excluded.
